Any practitioner that regularly deals with security interests knows that the regime prescribed by the Personal Property Securities Act 2009 (Cth) is highly complex. This session will look at what is necessary, in an electronic age, to constitute an informal will, and considers what constitutes a “document”. Presenter Anthea Kennedy will also consider the importance of the deceased’s intentions when considering an informal document, the role of computer experts in cases when determining the existence of a will, and the part played by interim and stop gap wills.  In examining these issues, the session will focus on relevant legislation and recent Court decisions.

Representing clients in NCAT’s Guardianship Division can be challenging for legal practitioners unfamiliar with the Division’s inquisitorial procedures. The Division is required to exercise its jurisdiction to give paramount consideration to the welfare and interests of people with disabilities in a manner that encourages informality, flexibility and dispatch. The head of the Division, NCAT Deputy President Anne Britton will outline and discuss the procedures employed by the Division designed to achieve those requirements. Ms Britton will also explore how the statutory duty imposed on legal practitioners to cooperate with the Division and the Appeal Panel works in practice.

We live in a globalised society where the residence of beneficiaries can change. Through the relationships of a beneficiary, an Australian family may have members who are non-Australian tax residents or foreign persons. This session will review the tax issues which arise including CGT and non-resident beneficiaries, land tax and stamp duty surcharges and trust distributions to non-resident beneficiaries.
