In their presentation, Greg McNally SC and David Stewart discuss the key legislative requirements for a binding financial agreement and the recent case of Bachman & Donohoe [2021] in Division 1 of the Federal Circuit and Family Court of Australia. This session will provide you with an understanding of the fundamental requirement of independent legal advice, the nature and quality of the legal advice required and the reliance on certificates of independent advice. It also covers issues relating to evidence of legal advisers in contested financial agreement matters.
