Professional skills for immigration lawyers - Immigration lawyers in their day-to-day practice work with clients with a diverse range of cultural and linguistic backgrounds. This session will deal with how to best work in this field; look at communication styles with clients and also Departmental officers and Tribunal members, including the use of interpreters and translators; and will cover certain aspects of the Migration Regulations that can affect future applications including Public Interest Criterion 4020. 

Practitioners should inform themselves of Rule 6.1 of the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules 2015 which sets out the requirements for the four (4) mandatory CPD areas for NSW legal practitioners – (a) ethics and professional responsibility; (b) practice management and business skills; (c) professional skills; and (d) substantive law. It is the responsibility of each legal practitioner to self-assess as to whether a particular educational activity extends their knowledge and skills in areas that are relevant to their practice needs or professional development.

Quite apart from managing the tax position of a family group or investment structure, the lawyer has a role in ensuring decision-making is in order. The lessons from recent cases like JJ Owies (VSCA), Grand View (UKPC) and Legler (NZCA, NZSC appeal heard) will be addressed. 

This interactive session will discuss strategies for improving decision-making and ensuring that the intended structuring and tax planning actually works.

Lucy Chapple, former lawyer and PhD candidate, explores how psychological science is reshaping our understanding of resilience, not as a fixed trait, but as a dynamic process that can be developed and strengthened over time. Drawing on current research, this session introduces the concept of mental fitness: the capability to sustain psychological functioning or quickly recover during and after exposure to stress.

Participants will gain insight into the different types of psychological stressors encountered in legal work and learn about three core mental capacities that support mental fitness.

The webinar will also introduce Mental Fitness in the Law, a new training and research program led by Macquarie University and tailored specifically for legal professionals.
